Agreement to Terms

By accessing or using the Boffo Marketing website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Our Services

Boffo Marketing provides website refresh and hosting services for small businesses. Our services include:

  • Website audits and assessments
  • Website design and development
  • Website hosting and maintenance
  • Related consulting services

Payment Terms

Payment for our Website Refresh package is due according to the payment schedule agreed upon when you engage our services. We accept major credit cards and other payment methods as communicated during the ordering process.

Payment Plans: We offer a two-payment option: 50% to start, 50% before launch. This must be arranged before work begins.

Refund Policy

Love-It-Or-Leave-It Guarantee: If you are not satisfied with your refreshed website before it goes live, we will provide a full refund. Once your website is published and live, refunds are not available for the design and development portion.

Hosting Refunds: Prepaid hosting fees are non-refundable but may be prorated if you cancel mid-term.

Intellectual Property

Your Content

You retain ownership of all content you provide to us, including text, images, logos, and other materials. By providing this content, you grant us a license to use it for the purpose of delivering our services.

Our Work

Upon full payment, you own the website we create for you, including the design and code. You may use, modify, and transfer your website as you see fit.

Third-Party Components

Your website may include third-party components (fonts, icons, libraries) that are subject to their own licenses. We will only use components that allow for commercial use.

Hosting Terms

If you use our hosting services:

  • Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service.
  • Backups: We maintain regular backups but recommend you keep your own copies of important content.
  • Acceptable Use: You may not use our hosting for illegal activities, spam, malware, or content that violates third-party rights.
  • Termination: We reserve the right to terminate hosting for violations of these terms or non-payment.

Limitation of Liability

To the maximum extent permitted by law, Boffo Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from our services shall not exceed the amount you paid us in the twelve months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will be error-free, uninterrupted, or meet your specific requirements.

Indemnification

You agree to indemnify and hold harmless Boffo Marketing from any claims, damages, or expenses arising from your use of our services, your content, or your violation of these terms.
